Serving terms of service

The terms governing use of the ProsGrow inference API. Draft, pending counsel.

Draft — not yet in effect. This document is a structural draft pending counsel review. It is not a binding agreement until ProsGrow publishes an executed version or it is attached to a signed order form. Section headings show the intended structure; the operative language is finalized by counsel.

Version 2026-08-02 (effective: not yet in effect).

Order of precedence (intended): a signed order form > these Serving Terms > the DPA > the data-retention exhibit > the corporate privacy policy. Customer API Content is governed by the DPA and the data-retention exhibit, not the corporate marketing-site privacy policy.

Scope of the OpenAI-compatible inference API and the console.

2. Accounts & API keys

Key issuance, customer responsibility for key secrecy and usage.

3. Acceptable use

Prohibited uses; abuse and rate-limit enforcement.

4. Fees, prepaid balance & billing

Prepaid model, metering basis (token counts), and non-refundability terms.

5. Data & privacy

Governed by the DPA and the data-retention exhibit.

6. Service levels

Any binding SLA is stated on the trust page or a signed order form.
